The Ryan White HIV/AIDS Treatment Modernization Act

The Ryan White Treatment Modernization Act (TMA) is a Federal Law that was passed by Congress in 1990. It was reauthorized in 1996 and again in 2000 and 2006. The TMA provides Federal Government Funds to develop systems of care and pay for medical and social support services for persons living with HIV disease and their families. Funds are distributed by the Health Resource and Service Administration (HRSA) to the Chief Elected Official (CEO) in an "Eligible Metropolitan Area"  (EMA). The TMA is broken out into Parts.  The Orlando EMA (Orange, Osceola, Seminole and Lake Counties) receives Part A funds which are e designated to the Mayor of Orange County for this EMA.  The EMA has been titled by HRSA as the "Orlando EMA." Part A funds go to areas that have been hardest hit by the HIV epidemic.  Part A funds cannot replace existing local/state funds or be used to pay for services which can be covered by other sources such as Medicaid, Medicare, state/local programs, or private health insurance plans.  Part A funds are used as a last resort in the payment for services. 

Services are provided through not-for-profit and government agencies.  Contracts for services are awarded to agencies based on a competitive bidding process.

Before an EMA can receive Part A money, the CEO must appoint an agency to administer the grant. In the Orlando EMA it is the Orange County Health and Family Services Department. In addition, the CEO must appoint an 'HIV Health Services Planning Council' (Planning Council). The Planning Council must be comprised of at least 33% Persons Living With HIV/AIDS (PLWH/A) and must have representatives from specified sectors of the community.

Ryan White Part A Office (Grantee Office)

Purpose:
The Chief Elected Official (CEO) of the Orlando EMA is The Honorable Richard T. Crotty, Orange County Mayor. Mayor Crotty has delegated the responsibility for the Part A grant to the Health & Family Services Department. The Health & Family Services Department established the Ryan White Title I Office to provide the administrative support and quality management for the grant.

Roles & Duties:
The duties of the Ryan White Part A Office are divided into two main categories: administrative support and quality management. The grantee office works closely with the HIV Health Services Planning Council and Grantee staff attend all Planning Council committees and functions. The grantee office is charged with: disbursement of grant funds, procurement of services, contracting for services, monitoring services, working with the Planning Council, and quality management.

As Grantee Office, the Health and Family Services Department is responsible for the following duties: prepare and submit Part A applications annually, administer service provider contracts, monitor contracts, report to the Planning Council, and disburse funds. The Grantee is allowed by law no more than 10% of the grant to cover costs of the Administrative Support duties and no more than 5% of the grant for Quality Management.
